Individual Tax Liability
Tax liability isn’t just limited to any income tax you might owe. The term covers all forms of taxes, such as capital gains and self-employment tax, as well as interest and penalties. RP Financial Services is here to help you navigate these liabilities.
Federal and State Tax Lien
A personal tax lien is the government’s legal claim against your personal property when you neglect or fail to pay a tax debt. The lien protects the government’s interest in all your property, including real estate, personal property and financial assets. The IRS and State file a public document, the Notice of Federal/ State Tax Lien, to alert creditors that the government has a legal right to your property.
Levy
An IRS levy permits the legal seizure of your property to satisfy a tax debt. It can garnish wages, take money in your bank or other financial account, seize and sell your vehicle(s), real estate and other personal property. You may appeal the IRS levy that was placed on your wages, bank account, or other property. It is strongly recommended that you respond to a levy notice in a timely manner.
Penalty Abatement
The IRS may provide administrative relief from a penalty that would otherwise be applicable under its First Time Penalty Abatement policy. You may qualify for administrative relief from penalties for failing to file a tax return, pay on time, and/or to deposit taxes when due under the Service's First Time Penalty Abatement.
Garnishments
Wage garnishment is a legal procedure in which a person's earnings are required by court order to be withheld by an employer for the payment of a debt such as an IRS tax liability. Title III of the Consumer Credit Protection Act (CCPA) prohibits an employer from discharging an employee whose earnings have been subject to garnishment for any one debt, regardless of the number of levies made or proceedings brought to collect it. You are entitled to certain rights as a taxpayer in the wage garnishment process, but it’s your responsibility to be aware of and exercise these rights. It is recommended that you consult a law attorney or legal aid to determine what’s best for you.
